Terms of Service
Effective: 13 May 2026
By downloading and using Waymark, you agree to these terms. They cover what the app does, your subscription, the limits of AI-generated content, your safety while using it, and how disputes are handled. We've tried to keep them readable.
1. The service
Waymark is a mobile application that provides ambient cultural stories about places near your location, using publicly available data and large language models. It is operated by Liriksoft.
2. Eligibility, age, and compliance
You may use Waymark if (i) you can lawfully form a binding contract in your country of residence and (ii) you are at least the age of legal capacity in your country (typically 18, sometimes lower). If you are below that age, you may use Waymark only with the consent and active supervision of a parent or legal guardian, who agrees to these terms on your behalf and is responsible for your compliance. The App Store rating of 4+ reflects that the app's content is suitable for general audiences; it is not a representation that any user under the legal age may form this contract independently.
Waymark has no signup process and does not maintain user accounts.
You represent that you are not located in any country subject to a comprehensive U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties (including the OFAC SDN list and the U.S. Department of Commerce Denied Persons List).
3. License
Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Waymark on Apple devices you own or control, for personal, non-commercial use.
You may not: (a) reverse engineer, decompile, or attempt to extract the source code of the app except to the extent permitted by applicable law; (b) use the app to build a competing product; (c) scrape, mass-extract, harvest, or republish stories generated by the app, whether for commercial use, dataset construction, AI training, or otherwise; (d) interfere with or attempt to circumvent any rate-limiting, paywall, authentication, or anti-abuse mechanism; (e) use the app to generate content that is illegal, infringing, harassing, hateful, or harmful, or to attempt to elicit such content from the AI; (f) use the app on behalf of a third party, as a "fronting" service, or in any way that bypasses these terms.
4. Subscriptions and auto-renewal
Waymark offers an auto-renewing Premium subscription at $3.99 per month or $24.99 per year (USD; local pricing may vary by App Store region). Pricing is shown in the app at the point of purchase.
- Payment is charged to your Apple ID at confirmation of purchase.
- Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscription in your Apple ID settings (Settings → your name → Subscriptions).
- No refunds or credits for partial subscription periods, except where required by law. Refund requests for App Store purchases are handled by Apple in accordance with Apple's policies.
The free tier of Waymark gives you 50 lifetime story cards and 5 follow-up questions per place. After the free quota is exhausted, you may continue to view your existing discoveries; new stories require a Premium subscription.
Fair use limits. Premium includes generous but not infinite daily usage caps to prevent abuse. The caps are set well above any normal pattern of use — equivalent to several hundred chat turns or stories per device per day. If you ever hit a cap, your usage resets the next day (UTC). We may adjust these limits over time to reflect real-world usage patterns; we will not lower them below what a normal walker could reach.
5. AI-generated content. Not advice. Verify before you act.
Waymark uses large language models to generate stories and conversational replies grounded in data from OpenStreetMap, Wikidata, and similar public sources. We do not warrant that any specific story or reply is accurate, complete, current, original, or fit for any particular purpose. The AI may confidently state things that are wrong.
No professional advice. Nothing produced by Waymark — story, chat reply, suggestion, or otherwise — is legal, financial, tax, medical, psychological, safety, navigational, engineering, scientific, or any other form of professional advice. If you need professional advice, consult a qualified professional, not an AI guide.
Verify before you act. Public-domain facts about places can be wrong, outdated, or misattributed even before AI touches them. If you are about to rely on a Waymark statement for anything that matters — a journalism article, an academic paper, a tour you sell, a guided route, a content publication, or any decision involving safety, money, or reputation — verify the underlying fact independently from a primary source.
You are solely responsible for your decisions and actions based on Waymark content. We make no commitment to correct, retract, or update any specific story.
6. Safety while using Waymark
Waymark surfaces stories while you walk. Your safety is your responsibility. By using Waymark you agree:
- To pay primary attention to your surroundings — traffic, terrain, weather, other pedestrians, obstacles — and not to your phone screen.
- Not to use the app while operating a motor vehicle, bicycle, scooter, or any other moving conveyance.
- Not to read the app while crossing streets, climbing stairs, traversing uneven terrain, or in any situation where your attention is needed elsewhere.
- That Waymark is not a navigation, mapping, emergency, accessibility, or safety-critical service, and must not be relied on for routing, evacuation, location accuracy, or any time-critical situation.
- That location data on mobile devices is approximate and may be wrong by tens or hundreds of meters, especially indoors, in urban canyons, near tall buildings, or in tunnels, and that the app may surface a story for the wrong location.
- That you assume all ordinary risks of walking outdoors — including traffic, weather, terrain, animals, and the actions of other people — independent of your use of the app.
- To follow all applicable laws, including pedestrian and traffic laws, and any local rules about phone use while walking.
To the maximum extent permitted by law, Liriksoft, its officers, employees, and affiliates are not liable for any injury, accident, death, property damage, or other loss arising from your use of Waymark while walking, moving, or otherwise interacting with the physical world.
7. Your content
The questions you ask the guide are sent to our servers and forwarded to a third-party AI provider to generate replies. By using the chat feature you grant us the limited right to process your messages for the purpose of returning a response and operating the service. We do not retain the contents of your chats beyond what's needed to serve the response, and we do not link them to a personal identity. See the Privacy Policy for details.
Don't submit content that is illegal, infringing, harassing, hateful, that targets a real identifiable person, that attempts to extract sensitive personal data about anyone, or that you don't have the right to share. We may rate-limit, block, or terminate access to abusive use of the chat feature.
8. Third-party data and services
Waymark relies on third-party services and data sources, including Anthropic (AI inference), Apple (in-app purchases and distribution), RevenueCat (subscription management), Cloudflare (hosting), OpenStreetMap, and Wikidata. Their terms and licenses apply to the data and services they provide. We are not responsible for the availability, accuracy, content, or practices of third-party services, and we do not warrant their continued availability.
9. Trademarks
"Waymark" and the Waymark wordmark are trademarks of Liriksoft. You may not use them without our prior written permission, except to refer accurately to the app in editorial or descriptive contexts in accordance with fair-use principles.
10. Termination
You may stop using Waymark at any time by uninstalling the app and cancelling your subscription via Apple. We may suspend or terminate your access if you breach these terms, abuse the service, or use the app in a way that harms our service, our third-party providers, or other users. We may also discontinue Waymark in whole or in part, at any time, with or without notice. If we terminate or discontinue, your subscription is not refundable except as required by law or Apple's policies, and you remain bound by sections that by their nature survive termination (including disclaimer, limitation of liability, indemnification, and governing law).
11. Disclaimer of warranties
Waymark is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, title, quiet enjoyment, and arising from course of dealing or usage of trade, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, secure, free of harmful components, or meet your requirements or expectations. We do not warrant any specific result from your use of the app.
12. Limitation of liability
To the fullest extent permitted by law, in no event will Liriksoft, its officers, directors, employees, agents, affiliates, suppliers, or licensors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of data, loss of profits, loss of revenue, loss of business, loss of goodwill, loss of opportunity, or any damages arising from reliance on AI-generated content, errors in location data, service interruptions, or third-party services — even if we have been advised of the possibility of such damages.
Our total cumulative liability arising out of or relating to these terms or your use of Waymark, regardless of the cause of action or theory of liability, will not exceed the greater of (a) the amount you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) ten U.S. dollars (USD $10).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions the above limitations apply to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Liriksoft and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of or access to Waymark; (b) your violation of these terms; (c) your violation of any third-party right, including any intellectual property, privacy, or publicity right; (d) any content you submit through the chat feature; or (e) any injury, accident, or property damage you cause to yourself or others while using or being near Waymark.
14. Apple-specific terms
If you obtained Waymark through the App Store, you acknowledge that:
- These terms are between you and Liriksoft, not Apple. Apple is not responsible for the app or its content.
- The license granted to you is limited to use on Apple devices you own or control, in accordance with the App Store Terms of Service (the "Usage Rules").
- Apple has no obligation to provide maintenance or support for the app.
- If Waymark fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the responsibility of Liriksoft.
- Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation. Any such claims are the responsibility of Liriksoft.
- In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, Liriksoft (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these terms against you.
15. General provisions
Force majeure
Neither party is liable for delay or failure to perform that is caused by circumstances beyond its reasonable control, including acts of God, war, terrorism, civil unrest, government actions, sanctions, natural disasters, pandemics, network or power outages, internet service interruptions, third-party service outages (including Apple, Anthropic, Cloudflare, RevenueCat, OpenStreetMap, or Wikidata), data center failures, or labor disputes.
Severability
If any provision of these terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect, and the invalid or unenforceable provision will be reformed to the minimum extent necessary to make it enforceable while preserving its original intent.
No waiver
Our failure to enforce any provision of these terms at any time is not a waiver of our right to enforce that or any other provision at a later time. A waiver is effective only if expressly stated in writing and signed (or e-signed) by an authorized representative of Liriksoft.
Entire agreement
These terms, together with the Privacy Policy and any in-app terms or notices we present at the time of a specific transaction, constitute the entire agreement between you and Liriksoft regarding Waymark and supersede any prior or contemporaneous agreements, communications, or proposals, whether oral or written.
Assignment
You may not assign or transfer these terms, by operation of law or otherwise, without our prior written consent; any attempt to do so is void. We may assign these terms freely, including in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, on notice to you.
No agency
Nothing in these terms creates any agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship between you and Liriksoft.
Notices
Notices to Liriksoft must be sent to waymark@liriksoft.com. We may give you notice in the app, by email if we have your address, or by posting on this page or the Privacy Policy page.
Survival
Sections that by their nature should survive termination of these terms will survive, including without limitation: sections 5 (AI content), 6 (Safety), 7 (Your content), 9 (Trademarks), 11 (Disclaimer of warranties), 12 (Limitation of liability), 13 (Indemnification), 14 (Apple-specific terms), and 17 (Governing law and disputes).
16. Changes to these terms
We may update these terms from time to time. If we make material changes, we will update the effective date at the top of this page and, where appropriate, notify users in the app. Continued use of Waymark after a change takes effect indicates your acceptance of the updated terms. If you do not agree to a change, your remedy is to stop using the app and cancel any subscription.
17. Governing law and disputes
These terms are governed by the laws of North Macedonia, without regard to its conflict-of-laws principles. The courts of Skopje, North Macedonia have exclusive jurisdiction over any dispute arising out of or relating to these terms or your use of Waymark, except that we may bring suit for injunctive or other equitable relief in any court of competent jurisdiction.
Consumer protection. If you are a consumer resident in the European Economic Area, the United Kingdom, Switzerland, or another jurisdiction whose mandatory consumer-protection laws apply, those laws continue to apply in addition to these terms, and you retain the right to bring a claim in the courts of your country of residence to the extent required by those laws. EU consumers may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr, though we prefer to resolve disputes by email first.
